Wrongful Death

Wrongful Death is a legal term describing a situation in which an individual is fatally injured due to the negligent behavior of another person, company or entity.

The death of a family member due to traumatic causes results in great anguish within a family. Surviving family members are often so overwhelmed by their loss that pursuing legal action appears trivial -- no lawsuit or amount of money will ever bring the decedent back. Therefore, many surviving spouses, parents, children and other family members never act upon their legal rights after a traumatic incident results in the death of their loved one. Negligent parties responsible for causing death are often never held responsible or accountable due to the failure of surviving family members to institute prompt legal action. More importantly, the negligent actors are never forced to learn from their mistakes and may repeat their conduct resulting in future needless and preventable deaths to others.

While understandable, the decision to forego or postpone legal action often results in great detriment to the legal rights and remedies available to the surviving family members.

Important evidence can be lost or destroyed following a fatal accident, and the memory of critical witnesses can fade, if not properly preserved. Oftentimes, a family member will seek legal counsel months or years after the loss, only to realize that crucial legal deadlines have elapsed. In these circumstances, the right to recover the future earnings of the decedent, and to obtain the emotional “closure” that many survivors yearn for, can be lost forever.
