What causes construction accidents?
A variety of circumstances cause construction accidents. Construction workers deal daily with heavy machinery and equipment, slippery conditions, scaffolding, ladders, electricity, vehicles of all types and sizes, and safety violations by employers and coworkers.
What injuries are caused by construction accidents?
Construction accidents can cause a wide range of injuries, including minor contusions and broken bones, lacerations, severe disfigurement, traumatic brain injury (TBI), paralysis, amputation, and even death.
Who is liable for a construction site accident?
The victim's employer, through its workers compensation insurer, is usually responsible for paying medical bills and some lost wages for injured construction workers in Massachusetts. Since the injured worker’s employer provides the workers compensation coverage, this employer cannot be sued by the injured worker. All amounts paid by workers compensation must be repaid upon resolution of the lawsuit. But injuries occurring on construction sites often result from safety violations of companies other than the injured worker’s employer. In the legal context, these other negligent companies are known as third parties. Thus, the injured worker brings a third-party lawsuit against the companies that violate safety rules and contribute to injuries. We examine every construction site accident to determine who, if anyone, violated the safety rules, and we will attempt to hold them accountable.
How do I choose a lawyer to represent me if I have been injured in a construction accident?
You should seek a reputable and experienced law firm specializing in construction accident law. The lawyer you choose should be able to demonstrate success in construction injury cases and have a good grasp on your type of injury in particular. The firm should also offer you a risk-free initial consultation for the attorneys to assess your case and for you to assess their abilities and commitment.
Our success at trial enhances the value of all our clients’ cases. Success at trial is the only leverage an injured person has against a large insurance company or other multi-national corporation. Not every lawyer has the experience, determination or resources to fully try a case to conclusion. Insurance companies carefully track those lawyers who are willing and able to try a case (and those who are not). Insurance companies and large multi-national corporations will take advantage of you if your lawyer has not demonstrated success at trial. It is important, then, that your lawyer have a track record of success at trial.
